1. Acceptance of Terms

By accessing, browsing, or using payoffmortgagecalculator.com (the “Site”), including any calculators, articles, tools, or pages under /payoff-scenarios/, /ca/, /uk/, /disclaimer/, /privacy-policy/, you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and our Disclaimer.

These Terms constitute a legally binding agreement between you (“User”, “you”) and Shahid Sadiq, owner of the Site (“we”, “us”, “Owner”). If you do not agree, you must immediately stop using the Site.

Age Requirement: You must be at least 18 years old, or have parental consent if 16-18, to use this Site per COPPA and UK Age Appropriate Design Code.

2. License to Use Calculators — What You Can Do

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Use our mortgage payoff calculators for personal, non-commercial, educational purposes
Share links to our pages on social media, blogs, or forums with attribution
Print or save calculator results for personal records and discussion with your licensed advisor

All calculations happen client-side in your browser. No server account is created. This license does not grant you ownership or rights to our code beyond personal use.

3. Prohibited Uses — What You Cannot Do

To protect site security, AdSense compliance, and other users, you agree NOT to:

Scrape, crawl, or copy content with bots, spiders, or automated tools beyond normal search engine indexing. Rate limit: 10 requests/second max.
Reverse-engineer our minified JavaScript beyond fair use for learning
Resell or re-host our calculators on your site via iframe or API without written permission from shahidsadiqtmp@gmail.com
Inject false data or attempt to manipulate calculations to produce misleading results for others
Use for illegal purpose: Do not use calculators to facilitate fraud, money laundering, predatory lending, or discrimination
Circumvent security: Do not attempt to bypass Cloudflare, Wordfence, or access admin areas
Spam: Do not use contact forms to send spam, phishing, or bulk unsolicited messages
Upload malware: Do not attempt to upload viruses, scripts, or malicious code

Violation results in immediate IP ban, termination, and potential legal action per Pakistan Cybercrime Act 2016 and US CFAA.

4. Intellectual Property & Copyright — Our Rights

Site Content: All articles, guides, payoff scenario explanations, tables, and original text are owned by us and protected by Pakistan Copyright Ordinance 1962 and US DMCA
Calculator Code: Underlying formulas (CFPB standard) are public domain. Our specific JavaScript implementation and UI/UX are proprietary, but formulas published open-source MIT for transparency
Trademarks: “Mortgage Payoff Calculator” and logo are unregistered trademarks. Do not use without permission
Third-Party Content: CFPB, Fed, IRS, OSFI, FCAC, FCA content remains property of respective governments. Used under fair use for educational commentary with attribution

Fair Use Allowed: You may quote up to 150 words with link back to source page and credit to Shahid Sadiq + yourdomain.com. For longer use, email shahidsadiqtmp@gmail.com.

5. User Content: Contact Form & Corrections

When you submit via contact form or shahidsadiqtmp@gmail.com, you grant us:

License to store, read, and respond to your message
Right to use anonymized feedback to improve calculators (e.g., “User asked for $250K bi-weekly” → we build that page) without identifying you
Right to quote anonymized corrections with your consent

You warrant that your message does not contain illegal content, malware, or third-party copyrighted text beyond fair use. Do NOT send sensitive financial data: account numbers, SSN, SIN, NIN, bank logins.

We retain contact emails 12 months per our Privacy Policy retention schedule.

6. No Financial Advice — Incorporates Full Disclaimer

This section incorporates our full Disclaimer by reference.

Shahid Sadiq is a software developer, NOT a licensed financial advisor, CPA, attorney, or FCA/FCAC-authorized mortgage professional. All calculators are for educational purposes only, based on public data from CFPB, Federal Reserve, HUD, IRS, OSFI, FCAC, Bank of Canada, FCA, Bank of England.

No advisor-client relationship created by use. You must consult qualified licensed professionals in your jurisdiction before making mortgage decisions. See full disclaimer for liability limits and methodology transparency.

7. No Warranty on Accuracy — As-Is Basis

Site and calculators provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including accuracy, completeness, timeliness, merchantability, fitness for particular purpose.

Specific limitations detailed in Disclaimer Section 9: fixed-rate assumption, monthly compounding, no escrow, principal-only application risk, tax deduction not included, prepayment penalty assumptions vary by jurisdiction.

8. Limitation of Liability — Maximum Protection

TO FULLEST EXTENT PERMITTED BY LAW:

We are not liable for direct, indirect, incidental, consequential, special, punitive, exemplary damages, including loss of profits, revenue, data, mortgage costs, penalties, tax liabilities arising from use.

Cap: Maximum aggregate liability shall not exceed $100 USD or amount you paid ($0), whichever greater.

Some jurisdictions do not allow limitation for personal injury, so this may not fully apply to you. For UK/EU consumers, nothing in these Terms excludes liability for fraud or gross negligence.

9. Indemnification

You agree to indemnify, defend, hold harmless Shahid Sadiq, hosting providers, contributors from claims, liabilities, damages, losses, costs, attorney fees arising from: your use, violation of Terms, violation of law, or mortgage decisions based on Site.

10. Third-Party Services & Ads — Your Agreement

Site uses Google AdSense, Google Analytics 4, Cloudflare, hosting provider. Your use of those services subject to their terms and privacy policies. We are not liable for third-party content, ads, or privacy practices. Ads marked “Sponsored”. We do NOT control ad content. We block sensitive categories per Google YMYL policy.

11. Termination of Access

We may terminate or suspend access, block IP, without notice for: violation of Terms, security threat, abuse, or legal requirement. You may stop using Site anytime. Sections 4-9 survive termination.

12. Governing Law & Dispute Resolution

Primary Jurisdiction: These Terms governed by laws of Islamic Republic of Pakistan, with reference to US YMYL consumer protection standards.

For US/UK/CA Users: You may also have rights under local consumer protection laws. For EU/UK residents, you retain mandatory consumer rights under local law.

Dispute Process:

Informal: Email shahidsadiqtmp@gmail.com within 30 days of dispute. We respond within 14 days, attempt good-faith resolution.
Mediation: If unresolved, non-binding mediation via online platform (e.g., Modria) before litigation.
Arbitration/Litigation: Any claim >$5,000 USD shall be resolved in courts of Chiniot, Punjab, Pakistan, unless consumer law requires local jurisdiction. You consent to jurisdiction there for convenience.

No Class Actions: You agree to bring claims individually only, not as class action, per Pakistan Arbitration Act 1940.

13. Changes to Terms

We may update Terms anytime to reflect law, tools, security. Material changes: new Last Updated date + 30-day homepage banner. Continued use after changes = acceptance. Version history at /changelog/. If you disagree, stop using Site.

14. Severability & Entire Agreement

If any provision of Terms found unenforceable by court, that provision severed, remaining provisions continue. These Terms + Privacy Policy + Disclaimer = entire agreement between you and us for Site use. No oral agreements.
